1. Service Description
LuxeSailingCharter (hereinafter "the Platform", "we", "us", or "our") operates an online booking platform accessible at www.luxesailingcharter.it that connects clients with independent boat owners and licensed professional skippers for yacht charter experiences along the Amalfi Coast and surrounding maritime areas. The Platform acts exclusively as a technological intermediary facilitating the booking process between the Client and the Operator (as defined below). LuxeSailingCharter is not a boat operator, transport carrier, travel agency, or tour operator. The charter service itself is provided by the independent Operator under their own maritime licences, insurance, and professional qualifications. By using the Platform and making a booking, you acknowledge and agree that the contractual relationship for the provision of the charter service is established between you (the Client) and the Operator, with LuxeSailingCharter acting as an intermediary to facilitate that transaction.
2. Definitions
For the purposes of these Terms and Conditions, the following definitions apply: "Client" or "You": any natural person aged 18 or over, or legal entity, who uses the Platform to search for, book, or purchase a charter experience. "Operator": the independent boat owner, charter company, or skipper who provides the vessel and/or navigation services for the charter experience. Operators are independent professionals and are not employees, agents, or representatives of LuxeSailingCharter. "Skipper": the licensed professional navigator responsible for the safe operation of the vessel during the charter. The Skipper may be the Operator or a person appointed by the Operator. "Owner": the registered owner of the vessel used for the charter experience. "Booking": a confirmed reservation for a charter experience made through the Platform, which becomes binding upon receipt of payment (deposit or full amount, as applicable). "Experience" or "Charter": the boat trip, excursion, or maritime activity booked through the Platform, including the use of the vessel, the services of the Skipper, and any ancillary services specified in the booking description. "Charter Day": the calendar day on which the charter experience is scheduled to take place. "Departure Port": the designated port, dock, or meeting point from which the charter experience departs, as specified in the booking confirmation.
3. Account Creation and Registration
Client Accounts: when you make your first booking through the Platform, a user account is automatically created using the personal information you provide during the booking process (name, email address, telephone number). This account allows you to view your booking history, manage upcoming reservations, and communicate with our customer service team. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Operator Accounts: access to the Platform as an Operator (boat owner or skipper) is by invitation only. Operators must provide valid documentation including, but not limited to, maritime licences, vessel registration, insurance certificates, and tax identification. LuxeSailingCharter reserves the right to verify, approve, suspend, or revoke Operator accounts at its sole discretion. You agree to provide accurate and complete information during registration and to update such information promptly if it changes. LuxeSailingCharter reserves the right to suspend or terminate accounts that contain false or misleading information.
4. Booking Process
The booking process on the Platform operates as follows: 1. Search and Browse: the Client searches for available charter experiences by selecting a date, departure area, vessel type, and number of passengers. 2. Selection: the Client selects a specific charter experience from the available options. Each listing includes a description of the vessel, itinerary, duration, included services, maximum passenger capacity, and pricing. 3. Booking Details: the Client provides the required personal information, number of passengers, and any special requests (e.g., dietary needs, celebrations, accessibility requirements). 4. Payment: the Client selects a payment method and completes the payment (deposit or full amount depending on the selected option). Available payment methods include credit/debit card (via Stripe), PayPal, Satispay, and cash (subject to specific conditions outlined in Section 5). 5. Confirmation: upon successful payment, the Client receives a booking confirmation by email containing the booking reference number, charter details, departure time and port, Skipper contact information, and any relevant instructions. A booking is considered confirmed and binding only upon successful receipt of payment by LuxeSailingCharter. Until payment is received, no reservation is guaranteed and availability may change.
5. Pricing and Payments
Currency: all prices displayed on the Platform are in Euros (EUR). Tax: prices are inclusive of VAT where applicable under Italian tax law. Invoices or receipts will be issued in accordance with Italian fiscal regulations. Deposit and Balance: - Online bookings: a deposit of 30% of the total charter price is required at the time of booking to secure your reservation. - The remaining balance of 70% must be paid no later than 7 (seven) calendar days before the Charter Day. - If the balance is not received by the deadline, LuxeSailingCharter reserves the right to treat the booking as cancelled by the Client, with the cancellation policy in Section 6 applying accordingly. - For bookings made within 7 days of the Charter Day, the full amount (100%) is required at the time of booking. Cash Payments: where cash payment is agreed upon, the full charter amount must be paid in cash directly to the Skipper or Operator at the time of boarding, before departure. Cash payment is available only for select experiences and must be arranged in advance. LuxeSailingCharter assumes no liability for cash payments made directly to third parties. Online Payment Processing: credit and debit card payments are processed securely by Stripe, Inc. in a PCI-DSS Level 1 compliant environment. PayPal payments are processed by PayPal (Europe) S.à r.l. et Cie, S.C.A. Satispay payments are processed by Satispay S.p.A. LuxeSailingCharter does not store or have access to your full card details. Additional Costs: certain on-board expenses are not included in the charter price and are the Client's responsibility, including but not limited to: fuel surcharges (where specified in the listing), entrance fees to marine grottoes or protected areas, food and beverages (unless expressly included), port fees at stops not on the standard itinerary, and any extras requested during the charter.
6. Cancellation and Refund Policy
All cancellation requests must be submitted in writing via email to info@luxesailingcharter.it. The cancellation date is the date on which we receive your written request. Refunds are calculated based on the number of calendar days between the cancellation date and the scheduled Charter Day. Client Cancellation: - More than 30 days before the Charter Day: 100% refund of the amount paid, minus a fixed administrative fee of €25.00. - Between 15 and 30 days before the Charter Day: 70% refund of the total charter price. - Between 7 and 14 days before the Charter Day: 50% refund of the total charter price. - Less than 7 days before the Charter Day: no refund. - Same-day cancellation or no-show: no refund. Refund Processing: approved refunds will be processed within 14 (fourteen) business days of the cancellation confirmation, using the same payment method as the original transaction. For cash bookings, refunds will be made by bank transfer to an account designated by the Client. LuxeSailingCharter Cancellation: in the unlikely event that LuxeSailingCharter must cancel a booking for reasons other than weather (e.g., vessel mechanical failure, Operator unavailability), the Client will be offered either a full refund or an equivalent alternative charter at no additional cost. In no event shall LuxeSailingCharter's liability exceed the total amount paid by the Client for the cancelled booking. Partial Cancellation: if the Client wishes to reduce the number of passengers after booking, such a change may be accommodated subject to availability but does not entitle the Client to a partial refund, as charter pricing is based on the vessel and experience, not per-passenger rates. Non-transferability: bookings are personal to the Client and may not be transferred or resold to third parties without prior written consent from LuxeSailingCharter.
7. Bad Weather Policy
Maritime Safety: the safety of all passengers and crew is the absolute priority. The decision on whether sea and weather conditions are suitable for departure rests exclusively with the Skipper and/or Operator, in compliance with the Italian Code of Navigation (Codice della Navigazione, R.D. 327/1942) and applicable maritime safety regulations. Cancellation Due to Weather: if the Skipper or Operator determines that conditions are unsafe for navigation (e.g., high winds, rough seas, severe weather warnings issued by the Capitaneria di Porto), the charter will be cancelled. In this case, the Client is entitled to: - A full refund (100%) of all amounts paid; OR - Rescheduling the charter to an alternative date at no additional cost, subject to availability. The Client must communicate their preference within 7 days of the weather cancellation. If no preference is communicated, a full refund will be issued. What Constitutes Bad Weather: the determination of unsafe weather is made by the Skipper based on professional judgement, official maritime weather bulletins, and the specific conditions at the departure port and along the planned route. Light rain, overcast skies, or mild wind alone do not constitute bad weather and are not grounds for cancellation with a refund. Client-Initiated Weather Cancellation: if the Client wishes to cancel based on their own assessment of the weather forecast (e.g., a forecast of rain), and the Skipper has not cancelled the charter, the standard Client cancellation policy in Section 6 applies. No preferential refund terms will be granted based on the Client's weather concerns if the Skipper deems conditions safe for navigation. Delayed Departure: in borderline conditions, the Skipper may decide to delay departure by up to 2 hours to wait for improving conditions. If conditions do not improve sufficiently, the charter will be cancelled with full refund or rescheduling rights as described above. If conditions improve and the charter proceeds with a delayed departure, the charter duration may be reduced accordingly.
8. Late Arrival and No-Show
Arrival Time: the Client and all passengers must arrive at the designated Departure Port no later than 15 (fifteen) minutes before the scheduled departure time indicated in the booking confirmation. Grace Period: if the Client or any passenger has not arrived by the scheduled departure time, a grace period of 15 (fifteen) minutes will be observed. The Skipper or LuxeSailingCharter customer service team will attempt to contact the Client by phone during this period. Departure After Grace Period: if the Client has not arrived and cannot be reached by the end of the 15-minute grace period, the charter will depart without the absent Client. No refund will be issued for a no-show. Late Arrival Within 30 Minutes: if the Client arrives late but within 30 (thirty) minutes of the scheduled departure time, the charter may still proceed at the Skipper's discretion. However, the charter duration will be reduced by the time lost due to the late arrival, and no refund or compensation will be provided for the lost time. Late Arrival Beyond 30 Minutes: if the Client arrives more than 30 minutes after the scheduled departure time, the charter will be considered a no-show. No refund will be issued. Group Bookings: for group bookings, the charter will depart once the grace period has elapsed, regardless of how many members of the group have arrived. It is the responsibility of the booking Client to ensure all passengers arrive on time.
9. Experience Expectations and Limitations
Indicative Itinerary: routes and itineraries described in charter listings are indicative and serve as a general guide. The actual route may be modified at the Skipper's discretion based on real-time weather conditions, sea state, marine traffic, port authority directives, and the safety and comfort of passengers. No guarantee is made that all listed destinations or stops will be visited. Access to Specific Locations: certain points of interest (including, but not limited to, the Grotta Azzurra / Blue Grotto of Capri, the Faraglioni, Li Galli islands, and marine protected areas) may be inaccessible due to conditions beyond the control of LuxeSailingCharter and the Operator, such as tidal conditions, overcrowding, local authority closures, or restricted access periods. The inability to access such locations does not entitle the Client to a refund or price reduction. Vessel Representation: photographs and descriptions of vessels on the Platform are intended to be representative. While we strive for accuracy, the actual vessel provided may differ slightly from the images in terms of colour, furnishings, or accessories. In the event that the originally booked vessel becomes unavailable (e.g., due to maintenance), the Operator may provide a substitute vessel of equivalent or superior category. If no suitable substitute is available, the booking will be cancelled with a full refund. Passenger Capacity: the maximum number of passengers indicated for each vessel is a strict legal safety limit established by the vessel's navigation certificate, in compliance with Italian maritime law. No exceptions can be made. If the Client arrives with more passengers than the maximum allowed, the excess passengers will not be permitted to board, and no refund will be issued for those passengers. Ancillary Services: where the charter listing includes ancillary services such as snorkelling equipment, paddle boards, aperitivo, or lunch, these are provided as described in the listing. Specific brands or products may vary. Clients with food allergies or dietary restrictions must inform us at the time of booking.
10. Client Responsibilities
By making a booking, the Client agrees to the following responsibilities: Accurate Information: the Client must provide truthful and accurate information at the time of booking, including the correct number of passengers and any special requirements. Health and Medical Conditions: the Client must inform LuxeSailingCharter of any medical conditions, physical disabilities, pregnancy, reduced mobility, or other health circumstances affecting any passenger that may be relevant to the safe conduct of the charter. Failure to disclose such information may result in denial of boarding without refund. Safety Compliance: all passengers must follow the Skipper's instructions at all times, particularly regarding safety procedures, use of life jackets, movement on board, swimming and diving, and embarkation/disembarkation. The Skipper has the authority to terminate the charter early if any passenger's behaviour poses a safety risk, and no refund will be given in such circumstances. Prohibited Substances: the possession, use, or distribution of illegal substances on board is strictly prohibited. Any violation will result in immediate termination of the charter, return to the nearest port, and no refund. LuxeSailingCharter reserves the right to report such incidents to the competent authorities. Personal Belongings: passengers are solely responsible for their personal belongings, including valuables, electronics, and documents. LuxeSailingCharter and the Operator accept no liability for loss, theft, or damage to personal items brought on board. Damage Reporting: the Client must report any damage to the vessel, equipment, or furnishings to the Skipper immediately upon occurrence. Appropriate Conduct: all passengers must behave respectfully towards the Skipper, other passengers, and the marine environment. Harassment, intimidation, excessive noise, intoxication that affects safety, littering in the sea, and any other antisocial or illegal behaviour are strictly prohibited. The Skipper may terminate the charter early and return to port in the event of inappropriate conduct, without any entitlement to refund.
11. Liability and Insurance
Intermediary Status: LuxeSailingCharter acts solely as an intermediary platform facilitating the booking between the Client and the Operator. To the maximum extent permitted by applicable law, including the Italian Consumer Code (Codice del Consumo, D.Lgs. 206/2005), LuxeSailingCharter shall not be liable for: - Personal injuries or death of passengers during the charter. - Damage to or loss of personal belongings. - The quality, safety, or suitability of the vessel provided by the Operator. - Acts, omissions, negligence, or misconduct of the Operator, Skipper, or their personnel. - Failure of the Operator to provide the charter service as described. Operator Insurance: each Operator is required to maintain appropriate maritime insurance, including third-party liability insurance (RC — Responsabilità Civile) and passenger liability coverage, as required by Italian maritime law and the Italian Code of Navigation. Proof of insurance is verified by LuxeSailingCharter before an Operator is admitted to the Platform. However, LuxeSailingCharter does not guarantee the adequacy or validity of such insurance. Limitation of Liability: in no event shall LuxeSailingCharter's aggregate liability to the Client, whether in contract, tort, or otherwise, exceed the total amount paid by the Client for the specific booking giving rise to the claim. Force Majeure: LuxeSailingCharter shall not be liable for any failure or delay in the performance of its obligations caused by events beyond its reasonable control, including but not limited to: natural disasters, pandemics, government restrictions, strikes, port closures, military action, civil unrest, or failures of third-party telecommunications or power networks.
12. Damage to Vessel
The Client is financially responsible for any damage to the vessel, its equipment, furnishings, or accessories caused by the willful act or gross negligence of the Client or any passenger in their party. In the event of damage: 1. The Skipper will document the damage (photographs, written description) in the presence of the Client where possible. 2. LuxeSailingCharter will provide the Client with a damage report and cost estimate from the Operator. 3. The Client will be invoiced for the repair or replacement cost. Disputed amounts may be resolved in accordance with the dispute resolution procedure in Section 14. Security Deposit: for certain charter experiences, a refundable security deposit may be required, as indicated in the listing. The deposit will be collected before departure and returned after the charter, provided no damage has been caused. If damage occurs, repair costs will be deducted from the deposit, and any excess costs will be invoiced to the Client. Normal Wear: the Client is not responsible for normal wear and tear resulting from the ordinary use of the vessel and its equipment during the charter.
13. Intellectual Property
All content on the Platform, including but not limited to text, graphics, logos, images, photographs, videos, user interface design, and software, is the property of LuxeSailingCharter or its licensors and is protected by Italian and international copyright, trademark, and intellectual property laws. You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any content from the Platform without the prior written consent of LuxeSailingCharter. User Content: by submitting reviews, photographs, or other content to the Platform, you grant LuxeSailingCharter a non-exclusive, worldwide, royalty-free, perpetual licence to use, reproduce, modify, and display such content in connection with the operation and promotion of the Platform.
14. Dispute Resolution
Amicable Resolution: in the event of any dispute arising from or in connection with these Terms, the booking, or the charter experience, the parties agree to first attempt to resolve the matter amicably. The Client should contact LuxeSailingCharter in writing at info@luxesailingcharter.it, providing a clear description of the issue and any supporting documentation. LuxeSailingCharter will use reasonable efforts to respond and propose a resolution within 30 (thirty) calendar days of receiving the complaint. Governing Law: these Terms and Conditions, and any dispute or claim arising out of or in connection with them, shall be governed by and construed in accordance with the laws of the Italian Republic, including the Italian Consumer Code (Codice del Consumo, D.Lgs. 206/2005) where applicable to consumer transactions. Jurisdiction: any legal proceedings arising out of or relating to these Terms shall be brought exclusively before the Tribunale di Salerno (Court of Salerno), Italy, without prejudice to any mandatory consumer protection provisions that may confer jurisdiction on the courts of the consumer's place of residence. EU Online Dispute Resolution: in accordance with Regulation (EU) No 524/2013, consumers resident in the European Union may submit complaints through the European Commission's Online Dispute Resolution (ODR) platform, accessible at: https://ec.europa.eu/consumers/odr/. When submitting a complaint, please use our contact email: info@luxesailingcharter.it. Consumer Rights: nothing in these Terms shall affect the mandatory rights of consumers under applicable EU and Italian consumer protection legislation, including the right to withdraw from distance contracts where applicable under Articles 52-59 of the Italian Consumer Code (D.Lgs. 206/2005). However, please note that pursuant to Article 59(1)(n) of the Italian Consumer Code, the right of withdrawal does not apply to contracts for the provision of leisure services where the contract provides for a specific date or period of performance.
15. Modifications to Terms
LuxeSailingCharter reserves the right to modify these Terms and Conditions at any time. The updated terms will be published on the Platform with an updated "Last updated" date. Material changes will be communicated to registered users via email at least 15 (fifteen) calendar days before they take effect. Continued use of the Platform after the effective date of any modifications constitutes acceptance of the updated Terms. Bookings confirmed before the effective date of a modification will be governed by the Terms in effect at the time the booking was confirmed.

17. Severability
If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity, illegality, or unenforceability shall not affect the remaining provisions, which shall continue in full force and effect. The invalid or unenforceable provision shall be replaced by a valid and enforceable provision that most closely achieves the economic and legal intent of the original provision, to the extent permitted by applicable law.
